1. According to new regulation SOLAS VI/5-1 (introduced by Resolution MSC.239(83)) ships carrying MARPOL Annex I cargoes, as defined in Appendix I to Annex I of the Protocol of 1978 relating to the International Convention for the Prevention of Pollution from Ships, 1973, shall be provided with a material safety data sheet (MSDS) prior to the loading of such cargoes.
The MSDS are to be based on Resolution MSC.150(77) ‘Recommendation for material safety data sheets (MSDS) for MARPOL Annex I cargoes and marine fuel oils’.
This requirement applies from 01.07.2009 to all Ships carrying cargoes, as defined above.
2. According to amended regulation SOLAS VI/5-1 (introduced by Resolution MSC.282(86)), ships carrying oil or oil fuel, as defined in regulation 1 of Annex 1 of the International Convention for the Prevention of Pollution from Ships, 1973, as modified by the Protocol of 1978 relating thereto, shall be provided with material safety data sheets, prior to the loading of such oil as cargo in bulk or bunkering of oil fuel (for use on board).
The MSDS are to be based on Resolution MSC.286(86) ‘Recommendations for material safety data sheets (MSDS) for MARPOL Annex I oil cargo and oil fuel’.
Amended regulation applies:
a) from 01.01.2011 to all ships carrying oil or oil fuel, as defined above, as cargo or bunkering oil fuel;
b) from 01.07.2009 to:
- all Panama flag ships – obligatorily,
- all St. Vincent and the Grenadines flag ships - as a recommendation carrying oil or oil fuel, as defined above as cargo in bulk or bunkering oil fuel.
3. Pending the entry into force of the amended regulation SOLAS VI/5-1 (acc. MSC.282(86)) members are urged to make the MSDS applicable also to oil fuel (for use on board). Ships should anticipate verification for compliance while at ports or terminals within territories of Parties to the SOLAS Convention.
